Permits & licensing in South Carolina.
South Carolina adopts at the state and interprets at the counter. The South Carolina Building Codes Council, inside the Department of Labor, Licensing and Regulation, adopts or modifies the model building codes and regulates the modular building program. From there the Council's own language governs: South Carolina is a home rule state, and each jurisdiction interprets and enforces the adopted codes for that jurisdiction alone.
The person reviewing the plan set is registered by the state. The Building Codes Enforcement Officers' Registration Practice Act requires every building code enforcement officer and every contract inspector to register with the Council before practicing anywhere in South Carolina. A Building Official registration authorizes all tasks and inspections inside a local building inspection department; a Plans Examiner registration authorizes building plans review.
Contractors answer to different boards entirely. The South Carolina Contractor's Licensing Board licenses general and mechanical contractors, construction managers, burglar alarm, fire alarm and fire sprinkler contractors; the South Carolina Residential Builders Commission holds residential builders and the residential specialty trades. On the coast a fourth authority sits over both: the Bureau of Coastal Management.
- The South Carolina Building Codes Council adopts and modifies the model codes; each jurisdiction then interprets and enforces them for itself under home rule.
- Building officials, plans examiners and contract inspectors hold a registration from the Building Codes Council before they may practice in any South Carolina jurisdiction.
- General and mechanical contractors license through the South Carolina Contractor's Licensing Board; residential builders and specialty trades through the South Carolina Residential Builders Commission.
- In the eight-county Coastal Zone, the Bureau of Coastal Management at the Department of Environmental Services permits directly in the critical areas — coastal waters, tidelands, beaches and the beach/dune system — and sets the beachfront baseline and setback line under § 48-39-280.
